1. Acceptance of Terms

These Terms of Service govern your access to and use of swept.gg, including discussion boards, profile pages, content submission tools, and any features we make available (the “Services”). By using the Services you agree to these Terms. If you enter any sweepstakes, giveaways, or other promotions (collectively, “Promotions”), the Official Rules for that Promotion apply in addition to these Terms. If there is a conflict, the Official Rules control for that Promotion.

2. Eligibility and Accounts

• You must be at least 13 years old to create an account. Promotions may require 18 or older and may be limited by location, as stated in the Official Rules.
• Provide accurate registration information and keep it updated. You are responsible for all activity that occurs under your account and for safeguarding your login credentials.
• If you sign up or connect through a third-party service, you authorize us to access the information that service shares with us, consistent with their terms and your settings.
• We may refuse, suspend, or terminate accounts to protect users, comply with law, or safeguard the Services.

3. Community Guidelines and Moderation

Our Community Guidelines are part of these Terms and are incorporated by reference. You agree not to post, share, or do any of the following:

• Illegal content or activity, harassment, hate, threats, doxxing, sexual content involving minors, exploitation, or incitement of violence.
• Spam, scams, deceptive practices, link bait, impersonation, or attempts to artificially inflate engagement, points, or entries.
• Infringement of intellectual property or privacy rights.
• Malware, phishing, scraping without permission, or attempts to bypass security or rate limits.
• Commercial solicitation without our prior written permission.
• We may remove content, limit features, suspend, or terminate accounts at our discretion. Serious or repeat violations can result in disqualification from Promotions.

4. User Content and License

“User Content” means anything you post or submit to the Services, including text, images, video, audio, links, and content surfaced through linked social accounts or hashtags.

• You retain ownership of your User Content.
• You grant Swept a non-exclusive, worldwide, transferable, sublicensable, royalty-free license to host, store, reproduce, adapt, modify, create derivative works, publish, publicly display, publicly perform, and distribute your User Content to operate, improve, and promote the Services and Promotions.
• You represent that you have all rights needed to grant this license and that your User Content does not violate law or third-party rights.
• We may display your username, avatar, and public profile with your User Content and may reformat or edit for display or compliance.

If your content includes music, footage, or other assets from third parties, you are responsible for obtaining necessary rights. Do not upload platform-added music overlays unless you have the right to use that audio outside that platform.

5. Promotions, Entries, Points, and Leaderboards

• Promotions are governed by their Official Rules. Read them carefully. They set eligibility, entry methods, start and end dates, winner selection and verification, tax obligations, and claim deadlines.
• Entries, points, badges, or leaderboard positions in the Services have no cash value unless an Official Rule clearly states otherwise.
• Automating entries, using bots or scripts, multi-accounting, or otherwise manipulating engagement is prohibited and can lead to removal, disqualification, and account action.
• We may modify, suspend, or cancel a Promotion if fraud, technical failure, or legal issues compromise its integrity. See Official Rules for details.
• Promotions are not sponsored, endorsed, or administered by TikTok, Instagram, X, YouTube, Threads, Discord, or any other third-party platform unless stated in the Official Rules.
• To help ensure fairness and prevent multiple or fraudulent submissions, we may collect and store IP addresses and related technical information (for example device identifiers, browser/OS metadata, timestamps, and activity logs) when you use the Services or participate in Promotions. This data is used solely for administration of the Services and Promotions and for fraud and security prevention, is protected with appropriate safeguards (including encryption in transit and at rest where applicable), and is not used for advertising or unrelated marketing.

6. Intellectual Property and DMCA

The Services include content owned by Swept and our licensors. Except as allowed by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Services.

If you believe that content on the Services infringes your copyright, send a DMCA notice to legal@swept.gg that includes: identification of the copyrighted work and the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that you are authorized to act for the rightsholder. We respond to valid notices and may disable repeat infringers.

7. Acceptable Use and Technical Restrictions

You agree not to:

• Access the Services using any automated means that impose an unreasonable burden.
• Reverse engineer, decompile, or attempt to extract source code except where allowed by law.
• Interfere with the operation of the Services, bypass access controls, or test vulnerabilities without written permission.
• Harvest or collect personal information about users without consent.

8. Third-Party Services and Links

The Services may link to or integrate with third-party sites and platforms. Their terms and privacy policies apply to those services. Swept is not responsible for third-party services and does not control their practices.

9. Communications

By creating an account you consent to receive service and transactional communications, such as account notices and security alerts. You can opt out of non-essential marketing emails as described in our Privacy Policy.

10. Privacy

Your use of the Services is subject to our Privacy Policy, which explains what data we collect and how we use it. The Privacy Policy is incorporated by reference into these Terms.

11. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent allowed by law, Swept disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent allowed by law, Swept and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of data, profits, or revenues, arising from or related to your use of the Services or any Promotion. Our total liability for any claim is limited to the greater of 100 dollars or the amount you paid to Swept in the 12 months before the event that gave rise to the claim. Some jurisdictions do not allow certain limitations, so these may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Swept and its affiliates, officers, employees, agents, and partners from and against claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your User Content, your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.

14. Dispute Resolution, Arbitration, and Class Action Waiver

You and Swept agree to resolve disputes through binding arbitration on an individual basis. Class actions and class arbitrations are not allowed.

• Rules and forum: American Arbitration Association, Consumer Arbitration Rules. Venue is Phoenix, Arizona.
• Small claims exception: Either party may bring an individual claim in small claims court.
• Opt-out: You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@swept.gg with your full name, the email tied to your account, and a clear statement that you opt out of arbitration.
• Governing law: Arizona law governs these Terms and any dispute, without regard to conflict-of-laws rules, except to the extent preempted by federal law.

15. Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will give reasonable notice by posting to the site or emailing you. Your continued use after changes take effect means you accept the updated Terms. If you do not agree, stop using the Services.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access for any reason, including policy violations, legal risk, or security concerns. Sections that should survive termination will continue to apply, including User Content license (to the extent needed for ongoing operation such as backups and logs), disclaimers, limitations of liability, indemnification, and dispute resolution.

17. International Use

Swept is a U.S. service. You are responsible for compliance with local laws. Promotions may be void where prohibited and may be limited by region as stated in the Official Rules.

18. Notices and Contact

We may send notices by posting on the Services or by email to the address associated with your account. Legal notices to Swept should be sent to legal@swept.gg and to the mailing address above.

19. Miscellaneous

• Entire agreement. These Terms, the Privacy Policy, the Community Guidelines, and any applicable Official Rules are the entire agreement between you and Swept regarding the Services.
• Severability. If any provision is unenforceable, the remaining provisions remain in effect.
• Assignment. You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or asset sale.
• No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
